These Terms & Conditions (“Terms”) govern your use of the Modterra website located at modterra.com (the “Site”) and the purchase of products from Modterra, a trade name of Raw Creative LLC (“Modterra,” “we,” “us,” or “our”).

By accessing the Site or purchasing products, you agree to these Terms.

1. Use of Website

The Site is provided for informational and commercial purposes. You agree to use it only for lawful purposes and not to:

  • Misuse or interfere with the Site’s functionality

  • Attempt to gain unauthorized access to systems or data

  • Copy, reproduce, or distribute content without permission

All content on this Site — including text, drawings, product designs, photography, and specifications — is the property of Modterra and may not be used without written consent.

2. Product Information

We strive to ensure that product descriptions, dimensions, and specifications are accurate. However:

  • All products are made by hand.

  • Slight variation in color, texture, and dimension is inherent to the material and process.

  • Website information is provided for general reference and may be updated without notice.

Final responsibility for verifying specifications prior to purchase rests with the Buyer.

3. Orders & Payment

All Modterra products are made to order unless otherwise stated.

By placing an order, you agree that:

  • Orders are final once production has begun.

  • Deposits and payments are non-refundable unless otherwise agreed in writing.

  • Payment terms will be provided at the time of order confirmation.

We reserve the right to refuse or cancel orders at our discretion.

4. Lead Times

Estimated lead times are provided as guidance only and are not guaranteed.

Production timelines may be affected by:

  • Material availability

  • Shop capacity

  • Customization requirements

  • Shipping carrier delays

Modterra is not liable for delays outside its reasonable control.

5. Shipping & Delivery

Risk of loss transfers to the Buyer upon delivery to the shipping carrier.

The Buyer is responsible for:

  • Inspecting shipments upon delivery

  • Noting visible damage with the carrier

  • Reporting concealed damage within [48–72 hours] of receipt

Failure to report shipping damage within the required timeframe may limit claim eligibility.

6. Installation Responsibility

Installation must be performed by qualified professionals.

Modterra is not responsible for:

  • Improper installation

  • Structural support issues

  • Plumbing errors

  • Damage caused during installation

Installation instructions are provided as guidance only. Final verification of site conditions remains the responsibility of the installer and project team.

7. Returns & Cancellations

Because products are made to order:

  • Returns are not accepted.

  • Order cancellations are not permitted once fabrication has begun.

Exceptions must be approved in writing.

8. Warranty

All products are subject to the Modterra Product Warranty. The Warranty document governs and controls in the event of any conflict with these Terms.

9. Limitation of Liability

To the fullest extent permitted by law:

  • Modterra’s total liability shall not exceed the purchase price of the product.

  • Modterra shall not be liable for indirect, incidental, consequential, or special damages, including lost profits, project delays, or reinstallation costs.

10. Intellectual Property

All product designs, technical drawings, renderings, text, and photography are the intellectual property of Modterra or its licensors.

No content may be reproduced or used without written permission.

11. Third-Party Links

The Site may contain links to third-party websites. We are not responsible for the content or privacy practices of those websites.

12. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

Any disputes shall be resolved in the state or federal courts located in Colorado.

13. Changes to Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date.
